A landmark multidistrict litigation against the makers of Xarelto
Beginning in 2014, numerous lawsuits were filed in federal courts throughout the country against Johnson & Johnson, Janssen Pharmaceuticals and Bayer Corporation — the manufacturers of Xarelto. The plaintiffs, who suffered from internal bleeding, infections and other injuries, allege the manufacturers failed to warn about the risks of taking Xarelto. The lawsuits were transferred and consolidated into a single multidistrict litigation (MDL) in the Eastern District of Louisiana under Judge Eldon Fallon in December 2014. At its peak, the Court had over 30,000 cases in the MDL.
After years of discovery and bellwether trials, Bayer and Janssen Pharmaceuticals announced a $775 million deal in March 2019 to settle nearly 25,000 of the pending lawsuits. Under the terms of the settlement, neither company admitted liability but agreed to the deal to avoid the costs associated with protracted litigation.
